First High Court battle won to save the badgers

CAMPAIGNERS fighting for the preservation of a family of badgers have won a High Court battle in a first step to overturn a previous planning decision.

Deputy High Court judge Timothy Corner agreed that outline planning permission for agreed that outline planning permission for a £3million development in Longaford Way, Hutton Mount, should not have been approved at a council planning meeting in February last year.

And so at a High Court hearing last week, he allowed Hutton Mount resident Ralph Patmore to take his appeal to a full judicial review hearing.

Mr Patmore is leading protesters' claims that the Stonebond Properties development would disrupt an active badgers' sett and the decision to allow the outline planning permission should not have gone ahead because an expert on the matter did not get his chance to speak when the matter was being discussed at that meeting.

He argues that a last minute change in running order meant that expert Adrian Coward missed his chance to speak on where the homes are located and how this would affect badgers living on the site.
